| spa |
| dc.description.abstractenglish | In Colombia, Transitory Detention Centers (TDCs), including police stations and substations, were created with the intention of serving as spaces for brief and exceptional custody. However, between 2020 and 2025, a structural contradiction became evident between the regulatory framework and actual practice: what was meant to be temporary detention frequently turned into prolonged confinement under conditions that fail to ensure a dignified life. This article examines how the Colombian State has responded to its obligation to protect human rights in TDCs, drawing on the American Convention on Human Rights and other standards of the Inter-American human rights system during this period. From a qualitative socio-legal approach, the study was conducted using a documentary design with a descriptive–analytical scope. It is structured around three levels of analysis: (i) an examination of the Inter-American legal framework governing deprivation of liberty; (ii) a systematic and bibliometric review of academic literature published between 2020 and 2025; and (iii) an analysis of the Colombian jurisprudential approach to TDCs, with particular attention to tutela rulings, follow-up orders, and Constitutional Court decisions in abstract judicial review. To this end, content analysis techniques, jurisprudential line review, and triangulation of documentary sources were employed. The main findings can be summarized in four points: (1) the supposed “transitory” nature of these centers operates in practice as a legal fiction that limits judicial oversight and opens the door to arbitrary detention; (2) the material conditions of many TDCs remain incompatible with human dignity, resulting in serious violations of personal integrity; (3) the COVID-19 pandemic exposed a structural crisis in the provision of healthcare for persons in custody; and (4) the combination of precarious infrastructure, weak oversight, and the presence of vulnerable populations increases the risks of institutional violence and discrimination. In conclusion, the State’s response has been largely reactive, driven by judicial orders and lacking a coordinated long-term strategy. This reveals a structural gap between the requirements of Inter-American human rights standards and the reality faced by persons deprived of liberty in Colombia’s TDCs. | spa |
